Terms and Conditions

In these terms and conditions, we or us means A.C.E. Travel Planning Pty Ltd. You or client means the person who has accepted these terms and conditions. These terms and conditions may be revised, amended or modified, without prior notice from time to time by updating this posting. The revised terms and conditions take effect when they are posted. A binding contract will only exist between you and a supplier when payment has been made by you and we confirm the booking. 

Agency: ACE Travel Planning Pty Ltd acts as a travel advisory service. We sell various travel related services on behalf of providers (“the providers”). ACE Travel Planning Pty Ltd have no responsibility for the services of the providers. All bookings are made subject to the terms and conditions imposed by the providers. You should not presume any legal relationship or joint venture, agency, partnership or employment agreement between ACE Travel Planning Pty Ltd and any provider or supplier.

Deposits: A 30% deposit per person is required upon booking to secure your reservation, with the balance being due at least 60 days prior  to travel

Cancellations: The client agrees that they will be liable for any cancellation fees incurred as a result of cancelling bookings with other service providers.

·          Loss of deposit if more than 60 days prior to arrival.

·          50% cancellation fee 60 days to 14  days prior to arrival

·          100% cancellation fee 14 days or less prior to arrival.

Refunds: No refunds will be made for unused services  where a client terminates the service after it has commenced regardless of reason.

Full Payment: A binding contract will be made by you when the deposit is received. Once you have made full payment there is no refund or change available other than as notified under any rules and conditions.

Insurance: It is essential that you obtain adequate travel insurance to cover cancellations, loss of deposits, bad weather, cancellation fees, baggage and medical expenses, illnesses, injuries and or accidents. ACE Travel Planning Pty Ltd do not provide travel insurance nor are we an insurance agency. Accordingly you must obtain your own insurance.

Chartered plane  flights: The charter flight company reserves the right to amend or cancel flight itineraries due to weather conditions or other unforeseen circumstances.

Baggage limits:  A baggage limit of  10 to 12kg per person applies. Soft luggage is requested. Passengers weight should also be supplied at the time of booking.

Accommodation: Every effort will be made to secure accommodation at a 3 or 4 star ratings establishment and on the date scheduled dates advertised but this is  subject to availability and may vary until bookings are confirmed and deposit received In the event that alternative accommodation having to be booked, notification will be made in writing and if necessary additional charges may have to be incurred. In some instances transfers to accommodation will not be part of the package.

*Passengers per tour (North West Western Australia tour): Packages may be arranged for up to 4 passengers, when transferring by chartered air flights. Separate arrangements regarding transfers, transport and accommodation may have to be made, other than what is advertised for the second group of 4 pax. Additional charges for accommodation may apply.

Liability: You agree that to the extent permitted by law ACE Travel Planning Pty Ltd shall have no liability whatsoever in relation to any personal injury, death or illness, damage or theft of personal property, expenses or inconvenience caused through delay, disappointed expectations, accidents or any other losses (including consequential loss) suffered by you or your dependants or your travel companions arising out of or in connection with any act or omission (including negligence) on the part of ACE Travel Planning Pty Ltd, its Directors, proprietors, employees, servants or agents or any service obtained through ACE Travel Planning Pty Ltd.

You agree to accept at your cost all risks in connection with the service provided by ACE Travel Planning Pty Ltd.

A.C.E Travel Planning Pty Ltd, its proprietors, agents, employees or affiliates will not be held responsible or liable for any changes having to be made to itineraries or bookings once they are completed and paid for. The client accepts that the changing of an itinerary may incur penalties or charges by other service providers and agrees that it is they who will be liable for such penalties or charges.

A.C.E Travel Planning Pty Ltd accepts no responsibility or liability for incorrect information. You agree that to the extent permitted by law ACE Travel Planning Pty Ltd shall have no liability whatsoever in relation to any personal injury, death or illness, damage or theft of personal property, expenses or inconvenience caused through delay, alteration or curtailment of any tour, disappointed expectations, accidents or any other losses (including consequential loss) suffered by you or your dependants or your travel companions arising out of or in connection with any act or omission (including negligence) on the part of ACE Travel Planning Pty Ltd, its Directors, proprietors, employees, servants or agents or any service obtained through ACE Travel Planning Pty Ltd.

You acknowledge and agree that to the extent permitted by the Trade Practices Act and relevant State legislation A.C.E Travel Planning Pty Ltd excludes liability under the Trade Practices Act to the fullest extent possible.

Whilst every endeavour will be made to keep the arrival/departure times stated in the itinerary, no guarantee will be made that these will be kept. A.C.E Travel Planning Pty Ltd will not be liable for any costs incurred through failure to connect with any other service. Any personal expenses incurred by the client as a result of any delay,

A.C.E. Travel Planning Pty Ltd does not take any responsibility in the event of accident or mishap.

Indemnity: By agreeing to these terms and conditions you agree to indemnify A.C.E Travel Planning Pty Ltd, its proprietors, agents, employees and suppliers from all claims, charges, demands, damage, liability, loss and expenses of any nature and however arising whether directly or indirectly incurred or suffered by A.C.E Travel Planning Pty Ltd  or any supplier directly or indirectly by reason of an act or omission which you commit in breach of these terms and conditions.

Disclaimer: A.C.E. Travel Planning Pty Ltd, it’s proprietors, agents, employees of will do it’s best to make sure your arrangements are satisfactory, however, no responsibility will be accepted for goods and services offered and supplied by third parties. A.C.E. Travel Planning Pty Ltd excludes all liability for any loss or damage whatsoever which may arise in any way in connection with the offer of goods and services arranged by A.C.E. Travel Planning Pty Ltd  on the behalf of any third parties.

Intellectual Property Rights: All itineraries are protected by copyright. The design and content featured including graphics, photography and the like are subject to copyright and is owned by A.C.E. Travel Planning Pty Ltd.

Amendments: A.C.E. Travel Planning Pty Ltd may, without prior notice, amend or modify these terms and conditions by posting the amended terms and conditions on the A.C.E. Travel Planning Pty Ltd website.

Privacy: Protection of your personal details is of the utmost importance to A.C.E Travel Planning Pty Ltd.  We will endeavour to maintain confidentiality over our client's information and will only provide your relevant personal details to other service providers solely for the purpose of booking travel arrangements or where required to under law.  This includes tour companies, car hire agencies and accommodation providers.

Legal Obligations: Before you proceed to book this service please be aware that you enter into a legally binding contract to acquire such service from the time payment is made. After this point any cancellations will incur the cancellation fees set out above.

You agree that A.C.E Travel Planning Pty Ltd  its proprietors, agents and employees are not liable to you in contract or in tort arising out of, or in connection with, or relating to: a) the services provided by A.C.E Travel Planning Pty Ltd   or any breach of these conditions; b) any fact, matter or thing relating to the services provided by A.C.E Travel Planning Pty Ltd; or c) any error (whether negligent or in breach of contract or not) in information supplied to you before or after the date of your use of A.C.E Travel Planning Pty services.   

Severability: If any provision of these terms and conditions is void or voidable or unenforceable or illegal but would not be void or voidable or unenforceable or illegal as aforesaid if it were read down and it is capable of being read down, it shall be read down accordingly.  

No Warranty:  ACE Travel Planning Pty Ltd provides its services (including its website) without any warranties (to the extent permitted by law).  In particular ACE Travel Planning Pty Ltd makes no representations nor gives any warranties that the services or products available through ACE Travel Planning Pty Ltd are suitable for your intended use or requirements. While all reasonable efforts will be made to ensure that any information or advice provided is correct (including cost information), ACE Travel Planning Pty Ltd gives no warranty as to the accuracy of such information, whether provided verbally or in writing.
